License Agreement

Before using the Kraken Stress Testing Toolkit, please read the terms of the following license agreement. Any use of the program by you constitutes your full and unconditional acceptance of its terms.

Unless you accept the terms of the license agreement in full, you may not use the Kraken Stress Testing Toolkit for any purpose.

1: General provisions

1.1 This License Agreement ("License") sets forth the terms and conditions of use of the Kraken Stress Testing Toolkit computer software (the "Program") and is entered into by and between any person using the Program ("User") and General Software (https://g-soft.info), the owner of the exclusive right to the Program ("Licensor").

1.2 By copying the Program, installing it on your personal device, or using the Program in any way, the User expressly and unconditionally agrees to all terms and conditions of the License.

2. Rights to the Program

2.1 The exclusive right to the Program belongs to the Licensor.

3.1 The Licensor grants the User the non-transferable right to use the Program on the territory of countries all over the world in the following ways, free of charge, on the terms of a simple (non-exclusive) license:

3.1.1 Use the Program for its direct functional purpose by copying and installing it on the User's personal device(s). The User has the right to install the Program on an unlimited number of personal devices.

3.1.2 Reproduce and distribute the Program in its unchanged form strictly for non-commercial purposes (free of charge).

4. limitations

4.1 Except for use to the extent and in the ways expressly provided for by this License or the laws of the Russian Federation, the User may not modify, decompile, disassemble, decrypt or perform any other actions with the object code of the Program aimed at extracting the source code of the Program and/or obtaining information on the implementation of algorithms used in the Program, create derivative works using the Program, as well as perform (allow to perform) any other use of the Program.

4.2 The User has no right to reproduce, distribute, publicize the Program in any form and by any means not expressly provided for by this License, including together with other programs, as part of collections of software products, with the offer of other programs, settings and other products, regardless of the purpose of such use, without the written consent of the Licensor.

4.3 The program shall be used under the name: Kraken Stress Testing Toolkit. The User is not entitled to change the name of the Program, change and/or remove copyright notice or other indications of the Copyright Holder or other persons present in the Program, documentation or other materials distributed with the Program.

5. Other terms and notices

5.1 The User is hereby notified and agrees that when using the Program, the following information is automatically and anonymously transmitted to the Licensor (without being bound to the User): IP address of the User's device, version of the Program.

6. Limitation of liability under the License

6.1 The Program is provided on an "as is" basis. The Licensor does not provide any warranties regarding error-free and uninterrupted operation of the Program, compliance of the Program with the User's specific goals and expectations, as well as does not provide any other warranties not expressly stated in this License.

6.2 To the maximum extent permitted by the applicable law, the Licensor shall not be liable for any direct or indirect consequences of any use or non-use of the Program and/or damage caused to the User and/or third parties as a result of any use or non-use of the Program, including due to possible errors or malfunctions of the Program.

7. Updates/new versions of the Program

7.1 The Program may automatically check for updates that are intended to improve the Program.

7.2 This License applies to all subsequent updates/new versions of the Program. Installation of an update/new version of the Program means that the User accepts the terms of this License for the corresponding updates/new versions of the Program, unless the update/installation of a new version of the Program is accompanied by a different license agreement.

8. Changes to the terms and conditions of this License

8.1 This license agreement may be changed by the Licensor unilaterally. Changes in the terms and conditions of the license agreement come into force from the date of their publication.
